Conditions of Use for The Web Site
The use of the SEPA site (hereafter "the site") of SH.A.L Diving Suits Ltd, (Company Registrar number 11745853) is under the following terms and conditions:
Terms and Conditions
These terms and conditions constitute a separate agreement between the user and the site's operators. It is understood and agreed that the site operators will not be responsible to the user in the event that these terms and conditions are violated by another user and that in the event of any violation by another user, the user can sue only the party that violated these terms and conditions and that he will have no claims or demands against the operators of the site.
The site operators can alter and change these terms and conditions from time to time at their sole discretion. The site operators will announce in advance and in a reasonable amount of time any such changes to users through an announcement published on the site or via electronic mail, according to circumstances and at their discretion. The continued usage of services provided by the site constitutes agreement by the user to any and all changes to these terms and conditions.
It is understood that only the terms and conditions expressed in this agreement are binding on the sites operators.
The company has exclusive and full copyright and intellectual property rights on the site's design and all programs, applications, computer code, graphic files, text and all other materials on the site. Nothing may be copied, distributed, displayed publicly or given to a third party without receiving the company's permission in advance and in writing. Trademarks used on the site are the sole property of the company, or, in the event that they appear on behalf of advertisers, the sole property of those advertisers. No use shall be made of them without permission in advance and in writing.
The company is entitled to close the site and change its design and/or format and/or availability of services and/or its contents from time to time and without needing to inform users in advance. You will have no claims or demands against the company in this matter.
The company does not guarantee that a service provided by the site will not be interrupted, will always be provided without interruption or disruption and/or will be immune from illegal access to the company's computers, damage, breakdowns, malfunctions, hardware, program or communications failures at the company or any of its suppliers or any other damage for any other reason and that the company will not be responsible for any damage, direct or indirect, distress and the like, caused the user or his property as a result.
The company will do its utmost to prevent your private details falling into a third parties hands, unless the company is forced to do so by a court order or threatened with legal action (criminal or civil) for failing to reveal information relating to activities on the company's site. In this eventuality, the company is entitled to reveal your details to the party who claims to have been injured or in accordance with a court order.
The company is entitled to stop you using the site if you do not adhere to these terms and conditions.
You will compensate the company, its employees, management, share holders or anyone working on their behalf for any damage, financial loses, lose of profits, payments or costs incurred including legal fees and lawyers fees, resulting from infringement of these terms and conditions.
These terms and conditions are in addition to all terms and conditions that may found on the site and in the event of incompatibility, these terms and conditions shall be deemed correct.
The company can change these terms and conditions with prior notice. The company will publish the new terms and conditions and the date upon which they become valid. Only the laws of the State of Israel will apply to these terms and conditions. Only the appropriate courts of law in the Tel Aviv/Jaffa district are eligible to hear cases in all matters relating to these terms and agreement.
Continuity, Availability and Reliability
The site operator, SH.A.L Diving Suits Ltd, can cease site services or operations whether advance notice has been given to users or not, without having any responsibility to users or any third parties regarding the cessation and/or change of these services.
The site operators do not guarantee that they will accede to any or all demands made by site users or that the service will not be interrupted and/or on time and secure and without mistakes. Additionally the site operators do not guarantee the results obtained by the user from using the site's services or regarding the accuracy and reliability of the information found on the site.
Site operators can cease a user's membership of the site at their sole discretion. The site operators will not be responsible for any harm or damage, direct or indirect, financial or otherwise, that is caused to the user through use of the site. The user is aware that his use of the site is at his sole responsibility.
Despite the aforementioned, site operators reserve the right to delete, to edit and to remove any content that is contradictory to the terms and conditions of usage and at their sole discretion. Any such action on the part of the site operators shall not be viewed as their taking responsibility for any content on the site that was not added by them.
Site operators will not be required or responsible, whether directly or indirectly, for the provision of compensation, whether by chance or specific or any compensation arising from the use of the site or the inability to use any of the site services and for the results of unauthorized entry or the alteration to announcements or information regarding users, even if the site operators have been advised as to the possibility of such a lose.
Site operators have the right to send electronic mail containing commercial advertisements. Site operators are not responsible for the contents of such messages, for the merchandise or services provided in them by a third party to the user and/or a third party. The user agrees that he will have no claims or demands against the site operators in this matter.
The service offered the user is "as is" and the site operators are in no way responsible for its relevance to the user and/or his purposes. The user agrees and confirms that he is aware that the site operators are not responsible, whether directly or indirectly, for any use he makes of the site and that he is solely and fully responsible for all use he makes or will make of the site and its services.
The site operators, including management, their employees and anybody working on their behalf, will not be responsible for any damage, whether directly or indirectly, that is caused the user and/or any third party through use of the information and/or contents and/or through cancellation and/or cessation of services including data corruption and/or defects whether caused maliciously by a third party or because of a technical malfunction.
Photographs in advertisements are for illustration only
It is possible that there may be differences in colors/designs that appear in photographs and the color/design of the product supplied to the customer. Photographs are for illustration only. In the event of a conflict or incompatibility: the words appearing in the title of the advertisement have precedence over the description as seen in the photograph. The wording of the advertisement has precedence over the wording in the advertisements title and the contents of the main body of the advertisement have precedence over the conditions of this agreement.
Information on Search engines and/or Price comparison sites
The site operators are not responsible in any way for advertisements not placed by them on the various search engines that have links to the site, forums, price comparison sites including the Zap price comparison site and the price comparison mechanism operated on its behalf on Tapuz, YNET, Golden Pages and others.
In the event of a product that is no longer in stock or there is a problem with its supply or approval of the purchase has not been received from the credit company with 24 hours following the end of the sale, SEPA is authorized to inform the customer and cancel the order. This is unilateral and within 72 hours following the purchase and via electronic mail, telephones fax or a message in the customer's order on the site.
Guarantee
3 year guarantee for stitching and zips on SEPA suits
1 year guarantee for diving equipment providing buoyancy vests and regulators are regularly serviced.
The guarantee is valid from the day of purchase and when accompanied by the original receipt.
Conditions of guarantee for SEPA products
•1. Guarantee for Neoprene suits and products
We guarantee all the components used in our factory and workshops such as: zippers, seams and stitching, gluing and various finishing strips and the quality of raw materials.
This is a lifetime guarantee. We will repair, at our own expense, all defects in materials or workmanship that are not the result of improper usage or unreasonable usage of the product.
Warning!
The seams and the protective layer covering the rubber fabric of the suit are prone to show signs of abrasion if rubbed against rough or hard surfaces such as rocks or other diving equipment (a buoyancy control device, for example, rubs the suit and leaves marks). Blue iridescent colors tend to fade quicker. Extensive use of the diving suit at greater depths compresses the rubber fabric of the suit.
Putting the suit on or removing it incorrectly or an excessive number of times will also cause faster wear on the suit. Excessive exposure to sunlight also causes the suit to wear faster.
Guarantee of suit's fitting
The company guarantees the suits size and fitting for one year following the date of purchase and at no extra cost. Alterations and additions such addition or removal of head covering, suit protection additions, extra zips that the client requests following purchase will be done according to the company's price list.
Guarantee for Lycra products
There is a lifetime guarantee on all stitching on Lycra products.
The guarantee is not valid for use not in accordance with the manufactures guidelines and instructions that can be found on the label.
For your information, bleach, chlorine, sun and sea water are the enemies of this product. After every use you must hand wash the product in fresh, lukewarm water. Use of bleach and of chemicals found in swimming pools causes the fabric to deteriorate quickly.
If rubbed against rough or hard surfaces such as rocks, surf boards, water slides, sand or diving equipment - particularly buoyancy control jackets - damage can be caused to the material.
Guarantee for bags and weight belts:
There is a life time guarantee for stitching, zips and the various finishing tapes. The guarantee is not valid for damage caused by improper or unusual treatment.
Important! Rough or hard surfaces as well as extended exposure or drying in the sun cause damage to the products durability. The products should be washed in fresh water after every use.
Cancellation charges
In the event that an order is cancelled before the product is dispatched to the client:
If the order is cancelled within seven working days - there is no cancellation fee.
Orders cancelled between seven to 14 working days will be charged a cancellation fee of 5% of the purchase price.
Cancellations will be honored only upon receipt of an official notification via email and return conformation, or via fax to the company's offices. The sending of an email without receiving conformation or leaving a voice message should not be viewed as an announcement of cancellation.
In the event that an order is cancelled after the product has been dispatched to the client:
An order can be cancelled up to 14 working days following the products dispatch to the client. A cancellation fee of 5% of the cost will be charged. The product must be returned via registered mail by the client within 14 working days from the date of the order. The product must be in its original packaging and unused! The packaging must be complete and undamaged! Under no circumstances should the order be cancelled by the purchaser before receiving confirmation from the company.
Additionally, responsibility for returning the product to the company/supplier is entirely the client's. The SEPA site will not be responsible and will not bear the costs for these shipping transactions!
Price Updates
Price updates are made constantly in order to guarantee the customer the lowest price. These changes demand human intervention that is both strenuous and difficult, through a computer content management interface. In the event of a mistake through human error, a typing error, the omission of a number, SEPA is not obligated to supply the product. SEPA declares that such mistakes can occur and if they do it is entirely innocent and that they should be viewed as human error. In the event that there is doubt regarding a product or price, if there is such a mistake or any other mistake, the customer must contact the company's Customer Service Department.
Shipping Costs
Shipping costs are 25 NIS including VAT.
Shipping costs will be collected when payment is made and in addition to the price of the product. (The products or products purchased through the site). The published prices are correct and valid only within the boundaries of the State of Israel and within the boundaries of the "Green Line" and include VAT. Prices do not include extras.
SEPA nor its agents will be responsible for any delay in the supply of products and/or services that are the result of conditions not under their control.
These include: communication system failures including telephone and computer, force majeure, industrial action including strikes, natural disasters etc.
Under these circumstances and/or others that are not under SEPA's control, it is possible that a sale/win may be unilaterally cancelled and a full refund granted at this time to the customer.
Additionally, we declare that we do not guarantee deliveries according to normal delivery schedules to those customers living in settlements that have access problems because of security issues - in such cases, a nearby delivery point can be arranged. (Shipping to the delivery point is charged at normal shipping rates).
Delivery at a date later that that stipulated - customers can store equipment at our warehouse. If a customer asks to store products and delivery at another date, working days will be calculated from the date requested and not from the original order date.
Special offers
All special offers are valid until stock runs out and can be cancelled unilaterally at any time. In the event that a specific product is advertised along with a free gift but the gift is no longer in stock, SEPA will provide a gift of a similar value and its sole discretion.
Product Colors
There is no guarantee regarding the color of the product supplied. However, SEPA will do all in its power to provide the products in the colors originally ordered.
